How the Supreme Court’s ‘shadow docket’ keeps the public – and other judges – in the dark

President Trump has submitted a record number of emergency cases to the Supreme Court’s “shadow docket,” persuading it to overturn lower court rulings that go against his administration’s policies. Slate senior writer Mark Joseph Stern warns the high court is giving Trump “unprecedented control over the federal government” with little or no explanation and even less transparency. Jeff Rosen says its use of the shadow docket “invites chaos.”
